JAHACO – Retail E-Commerce (B2C)
1. Definitions
For the purposes of these Terms and Conditions, the following terms shall have the meanings set forth below unless the context otherwise requires:
- Company: Al-Juffali Air Conditioning & Home Appliances Co. (JAHACO).
- Website: The electronic platform owned and operated by the Company.
- Consumer: Any natural person who purchases a product for personal, non-commercial use.
- Service: The retail sale of products through the Website.
2. Scope of Application
These Terms apply to all retail (B2C) sales transactions conducted through the Website within the Kingdom of Saudi Arabia.
3. Acceptance
Use of the Website or completion of any purchase constitutes the Consumer’s express acceptance of these Terms and the Privacy Policy.
4. Products and Pricing
- All prices are stated in Saudi Riyals (SAR) and include Value Added Tax (VAT) unless expressly stated otherwise.
- The Company reserves the right to amend prices at any time without retroactive effect on confirmed orders.
5. Payment
- Payments shall be made through approved electronic payment methods within the Kingdom.
- Payment processing is carried out by licensed third-party service providers.
- The Company does not store card payment details, and all payment processing is conducted in compliance with the Saudi Personal Data Protection Law (PDPL).
6. Marketing Communications
- No marketing or promotional messages shall be sent without the Consumer’s prior explicit consent.
- The Consumer may opt out of marketing communications at any time without any obligation.
7. Delivery
- Products shall be delivered within the timeframe indicated at the time of checkout.
- In the event of unjustified delay, the Consumer has the right to cancel the order and receive a full refund.
8. Returns and Exchanges
- The Consumer has the right to return products within 14 days from the date of receipt, in accordance with the Saudi E-Commerce Law, unless the product is among statutory exceptions.
- In cases of manufacturing defects or non-conformity with specifications, the Company shall bear all return costs.
- Returned products must be unused and in their original condition, unless the defect is inherent.
9. Refunds
- Refunds shall be issued to the original payment method within a maximum of 14 business days from the date of approval.
10. Intellectual Property
All Website content is protected under the Saudi Copyright Law. No content may be used, reproduced, or distributed without the Company’s prior written consent.
11. Lawful Use
The Website may not be used for any unlawful purpose or in violation of the laws and regulations of the Kingdom of Saudi Arabia.
12. Personal Data Protection
The Company processes personal data in compliance with the Saudi Personal Data Protection Law (PDPL) and collects and uses data only for lawful and declared purposes.
13. Limitation of Liability
To the extent permitted by applicable law, the Company’s liability shall be limited to the value of the product concerned and shall not include any indirect, incidental, or consequential damages.
14. Termination
The Company may suspend or terminate any account in the event of misuse or breach of these Terms, without prejudice to the Consumer’s statutory rights.
15. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia, and the Saudi courts shall have exclusive jurisdiction.
16. Amendments
The Company shall notify Users of any material amendments to these Terms. Continued use of the Website after such amendments constitutes acceptance thereof.
